These are umbrella terms. A specific app, game, purchase, logistics engagement, publishing agreement, or other TWP venture may use additional terms, order documents, platform rules, or contracts. Those additional terms control for that product or transaction if they conflict with these general terms.
1. Acceptance
By accessing or using a TWP service that links to these Terms, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. If you use a service on behalf of an organization, you represent that you have authority to bind that organization.
2. TWP products and services
The Way Partners develops and operates a range of ventures, including software, apps, games, publishing and intellectual property, consumer products, commerce, logistics, distribution, and AI-enabled services. Features may change over time, and some services may be experimental, limited, or discontinued.
Descriptions on this website are general and do not create a commitment to provide a particular product, feature, commercial term, or service level.
3. Accounts and access
If a service requires an account, you are responsible for providing accurate information, keeping credentials secure, and notifying us of suspected unauthorized access. You may not share credentials in a way that circumvents product limits or security controls.
You must use TWP services in compliance with applicable law, platform rules, age requirements, and any product-specific terms.
4. Content, ownership, and intellectual property
TWP and its licensors retain all rights in TWP software, games, artwork, text, brands, designs, concepts, publications, interfaces, and other materials, except for content that you own and submit to a service. These Terms do not transfer ownership of TWP intellectual property to you.
Subject to these Terms, TWP grants you a limited, personal, revocable, non-exclusive, non-transferable right to use a consumer service for its intended purpose. Commercial rights, publishing rights, licenses, logistics services, and business engagements require separate written terms where applicable.
If you submit feedback or suggestions about a TWP service, you permit TWP to use that feedback without restriction or compensation, but you retain ownership of your underlying pre-existing materials.
5. AI-enabled features and informational content
Some TWP products may use artificial intelligence, simulations, analogies, games, or generated content to help users explore ideas or solve problems. Outputs can be incomplete, inaccurate, or inappropriate for a particular situation and should be independently evaluated.
Unless a specific service expressly states otherwise, TWP content and AI-enabled features are provided for general informational, educational, creative, or entertainment purposes and are not legal, medical, financial, tax, engineering, or other professional advice. Do not rely on them as a substitute for qualified professional judgment in high-stakes matters.
6. Purchases, consumer products, logistics, and fulfillment
Purchases may be subject to additional checkout, marketplace, shipping, return, subscription, or platform terms presented at the time of purchase. Taxes, shipping availability, delivery estimates, and refund rights may vary by product and location.
Third-party logistics, warehousing, distribution, transportation coordination, and other business-to-business services are governed by the applicable proposal, statement of work, service agreement, tariff, order document, or other written commercial terms. Nothing on this website creates a carrier, broker, warehouse, agency, fiduciary, or other regulated relationship unless expressly established in a separate written agreement.
7. Acceptable use
You may not use a TWP service to violate law or another person’s rights; access or interfere with systems without authorization; introduce malware; evade security or rate limits; scrape or copy a service in violation of applicable restrictions; impersonate others; harass or exploit people; submit unlawful or infringing content; or use a service in a way that creates material risk to TWP, other users, or third parties.
We may investigate suspected misuse and take reasonable protective action, including limiting or suspending access.
8. Third-party services
TWP services may integrate or link to third-party platforms, app stores, payment providers, AI providers, analytics tools, shipping providers, or other services. Those third parties may apply their own terms and privacy policies. TWP is not responsible for third-party services outside our control.
9. Disclaimers
To the maximum extent permitted by law, TWP services are provided “as is” and “as available.” TWP disclaims warranties not expressly stated in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, TWP and its affiliates, owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to a service.
Where liability cannot lawfully be excluded, it will be limited to the extent permitted by applicable law and any product-specific agreement. Nothing in these Terms limits liability that cannot legally be limited.
11. Responsibility for your use
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful use of a service, your material violation of these Terms, or content you submit that infringes another person’s rights. This section does not apply where prohibited by law.
12. Suspension and termination
You may stop using a TWP service at any time. We may suspend or terminate access when reasonably necessary for security, legal compliance, prevention of misuse, nonpayment, or material violation of applicable terms. Product-specific rights regarding cancellation, refunds, data export, or account deletion may also apply.
13. Product-specific law and dispute terms
Applicable law, venue, arbitration, or other dispute terms may be specified in product-specific or commercial agreements. If no additional agreement applies, these Terms do not waive any rights or obligations imposed by the law that otherwise governs the relationship.
14. Changes to these Terms
We may update these Terms from time to time. We will post the revised version and update the effective date. If required by law or appropriate for a material change, we will provide additional notice.
